Adam Gershenson is an established courtroom lawyer who helps companies win trade secret disputes, class actions and complex cases. At trial and on appeal, he has successfully represented clients in bet-the-company matters involving unfair competition, false advertising, patents, trademarks and trade secrets. He also secured significant victories in cases concerning breaches of contract and constitutional rights, including high-stakes disputes involving the First Amendment. Adam is the newly elected chair of the ABA IPL Trial and Appellate Procedure Committee. He is also co-chair of the ABA Joint Task Force on Model Trade Secret Practice.

  • National Fish & Seafood v. Tampa Bay Fisheries – Entered case after court imposed a temporary restraining order and preliminary injunction; successfully argued to have both orders dissolved, and obtained dismissal with prejudice.
  • Starcoin v. Axiom Zen – Won trade secret case defending the world's most popular commercial application of blockchain technology, CryptoKitties. Defeated injunction and secured dismissal of all claims.
  • SimpliVity v Bondranko  – Represented plaintiff in trade secret case, secured an injunction, and protected plaintiff’s confidential information from competitor.
  • Profil v Profil  – Represented defendant in trade secret and trademark case, defeated injunction, and ensured defendant’s freedom to operate.
  • Blay v. Zipcar – Won outright dismissal of purported class action.
  • EMC Corp. v. Pure Storage – Won favorable settlement on eve of trial in major litigation for client accused of conspiracy to steal trade secrets and to solicit competitors’ customers and employees.
  • Twitter Inc. v. Ahmed – Won dismissal of trademark infringement suit.
  • General Electric v. Wilkins – Secured a trial victory for a leading wind turbine manufacturer in a patent inventorship dispute.
  • MAPCS v. Massachusetts Attorney General – Won summary judgement that imposed regulations were unconstitutional an invalid under the First Amendment.
  • Boumediene v. Bush –  Established victory at trial and at the Supreme Court to free from Guantanamo Bay prison five wrongly-accused men.
  • Special Assistant District Attorney – Successfully first-chaired multiple trials and argued dozens of successful motions.
